The article does mention that there were additional reasons for the work stoppage, one of which was that blasting would exacerbate Christmastime traffic in Green Hills. In that light the delay would seem a voluntary move on SL's part to preserve goodwill, especially since nothing legally prevents work from continuing, as the author noted.

For damages due to delays. I spoke to WW about this and was already being discussed by another person that was familiar with the situation. He is a developer, but not with SL, and he said the GHNA has opened themselves up for a counter suit if the delay cost SL money.

 

Correcto.

 

(Now whether SLand would win the countersuit....)

Not that I think GHNA is right, but they have a right to appeal the original decision. I'm not sure you can sue someone for a delay caused by their right of appeal.  Seems like that right trumps. I can see them having to pay court costs, etc., and that alone might sink them.  But hey, I'm not a lawyer; just married to one (and none of it has rubbed off).

You can sue or counter sue anyone, any group, or any business for any reason. That does not mean you will win. Ask your wife and I think she will agree.

 

I don't think the neighborhood folks have a snow balls chance in a nuclear attack of winning. Southern Land has done everything according to current zoning and law. If they do counter sue, the neighborhood assn. will have to spend money to defend a lawsuit. I am sure Southern Land has some real good lawyers and deep pockets.

Yes, I should of said successfully sue.  I have a feeling the association probably has some lawyers on their board or close to their board.

For those interested in IKEA, the space where Hillwood Strike and Spare was closed last month,  (The 10th or so bowling center to close in Nashville in the past 25 years) At Home is locating in the space where the bowling center was which was about 50,000 square feet.
