Nice to see where the priorities are.Drive through restaurants that serve everyone no,but exclusive establishments that serve the privileged few yes?

The point is not what types of food/beverages are served, but trying to create a pedestrian environment and an urban street edge.  Imagine if every block of Main Street (CBD) had a drive thru restaurant in the middle of the block that every car had to drive across the sidewalk to exit the property.

Pendleton St is different than Main St.Any attempt to bridge the gap between Main St and the Village at West end is going to have to have a wide and diverse mix of retail and commercial use.Drive through restaurants offer another option to the growth of that corridor.RDV is the wrong zoning if you want to encourage growth.

Pendleton Street will never be pedestrian friendly as long as it remains a four lane road between Main and Academy. Allowing restaurants like Burger King doesn’t help matters either.

That's why it isn't going to be four lanes long term.  The West End Small Area Plan details the options.

Crossing Academy is more of an impediment than the fact that a BK is on that corner.

I do not mind Pendleton St changing to two lanes with a central turn median and two bike lanes on  either side.Nice sidewalks for pedestrians would also be great. Both would not be an impediment to retail businesses, drive throughs included.I would vehemently oppose any elevated/impassable median that restricted access or departure.

Why propose taking over the ownership of the road without the intent of control?

Of course they will control the road if they take ownership.  But the owner of the road (city, county or state) has no bearing on what is built or operated on the property fronting that road.

If the city decided to build a hard or elevated median it would restrict the direction which you could either enter or exit a structure. That would cause access issues and dissuade certain uses.

That’s a big “IF” you’re getting all worked up about. Don’t forget: this is a hypothetical discussion at this point.
The City would not move forward with such a decision without property owner and community input.

My brother and I are defending ourselves and the interests of future commercial property owners. The city  has not in any way try to placate or allay our fear and discomfort. It does not help when the WE neighborhood association gangs up against us as well. Our only option is a Judicial review with a jury trial. We will pursue a just and reasonable outcome at our expense. If it comes out that RDV is an illegal zoning ordinance and that we were treated differently than our neighbors then the city will have to answer for itself.
