And speaking of clusters, that's kind of where we are right now.  Not just adding a tower here and there, but also adding clusters here and there.   I keep daydreaming of a future shot of downtown once the Yards cluster, the circle cluster, this cluster, the Reed cluster, the Church St. cluster (Tony G's twins, 1000, Streetlights), what I'm calling the Central Gulch cluster (Highwoods, Gibson, Edition, One22One, Market St., Modera McGavock), and maybe even the Cummins cluster are ALL in place.  Yes, please.  I'll take them all.

Homeowners near the site of two-tower project 2nd & Peabody have filed an appeal in Davidson County Chancery Court, saying that the Metro Planning Commission "arbitrarily, capriciously and illegally" approved a large height extension for the towers, according to legal documents. The petitioners, Steven Snyder, Andrew Decker and Gregory Breetz, said through a lawyer that the project, spearheaded by Four Seasons developer Dean Stratouly, would affect their property values and views, as well as “destroy the character of” the Rutledge Hill and Lafayette neighborhoods. Douglas Berry of Miller & Martin PLLC is representing Snyder, Decker and Breetz, according to court documents.

They are going to have a hard road to prove it will hurt the property values as projects like this normally make you property values go up. Not to mention they are only four out of how many residents suing!

I don’t know why they use this in their argument. As if what is on the site now is contributing anymore to the character. They should see this as an investment in the neighborhood that at the very least is bringing a large new park to the area that was once a parking lot. I’m sure they are just using that as leverage as what really concerns them are the blocked views. Who knows, maybe after enough lawyers, they’ll run out of money…and lawyers!

If views are a concern they’re in for a rude awakening when 133 KVB and the Bode parcel are eventually redeveloped. Can’t do anything about height on those parcels. 
 

The argument about neighborhood character is just baffling to me. Nothing about 2nd and Peabody detracts from the historic character of Rutledge Hill neighborhood. That section of 2nd and the Lafayette district is a total no-man’s land as far as pedestrian amenities are concerned. The bulk of the historic building stock is to the SE of the site, and the park, retail spaces, and connectivity upgrades are a major bonus for the neighborhood.

HaHaHaHa..chuckle, HaHa … I can’t stop laughing at these three ( let’s just call them Larry, Curly & Mo) you move into the core of a rapidly growing city and expect to have suburban like views, that will never change!  Come on, nobody’s that dumb. Sounds to me that they think their privileged , better then the rest , have money and don’t care about anything but themselves kind of folks. If they have this kind of money to burn, maybe instead of being total a-holes , they should go buy a penthouse in the Four Seasons and have themselves some awesome views!

You're getting beautiful buildings added to your neighborhood, a good amount of green space, and increased vibrancy. You're losing an ugly industrial, run down complex.

 

In life you should choose what you fight for. This lawsuit seems like such a waste of energy

These people and their frivolous lawsuits. I wish I had nothing better to do than throw away time and money complaining about the view from my apartment in a semi-sketch part of town.

They will also get their views blocked when MDHA develops the last lot at Hermitage and KVB. That will get a 30 story building or better at that location .

In addition the lawsuit is also possibly an attempt to frighten off or change the plans of the Cumulus developers, or to get the planning committee to reject the Cumulus development plan.
