THANK YOU... I mean honestly, what's the point anyway of these people residing in an urban environment if they're opposed to amenities moving in nearby?  That's kinda the whole point... or part of it anyway.

You wouldn't believe the number of people who live downtown literally at towers with bars and restaurants at the base and ask for MNPD to respond to loud music.

So with this court ruling, when do we see movement on these projects?

Depends on if there is an appeal to a higher court. I think both sides are probably looking at case histories to determine strategies on what the other side does. If there is an appeal, the other two groups will already be prepared to defend based on previous lawsuits as they have an army of lawyers the other side does not have, and that appeal will be VERY expensive and costly for those three at the City Lights Condos. 

My guess is they will cut their losses. It just depends on how much money they want to spend. I just do not know how many hours of attorney's fees it would take for an appeal. Maybe a lawyer on the board would know, but I would guess the cost would be around $250 an hour????

If those three individuals have that much money to freely spend on this nonsense, then they surely have the funds to move to somewhere that they can find the solitude and open views they feel that they deserve. This is becoming a real PITA , and they need to shut up and move on.

It's called Bucksnort! Just kidding, LOL. In all seriousness the folks moved here from large cities and should have realized that moving to downtown Nashville and wanting peace and quiet, no buildings, no construction, and no threat of construction is like moving to the woods and not wanting nature, trees, wild animals and the threats that go along with such. It is an oxymoron at its finest.

I have no idea what they were expecting. The DTC's and zoning can be changed in a heartbeat in a manner of speaking, and they would not delay zoning for one small group of individuals. If planning had not done this at this time, then they would have done it through other means at a later time. These folks are truly a bit clueless. Even if they win an appeal, Metro can turn around and change the entire zoning structure through Metro Council the way they are arguing they want, and where would they be then. They are only delaying the inevitable of what will come sooner or later.

Exactly.  If they wanted a city that never changes they could've moved to Buffalo or something.  Not a knock on Buffalo mind you, I actually think it's a pretty fantastic and underrated town, but let's face it it hasn't changed in decades.

I have a friend with a two unit rental house for sale now in Buffalo. They can make the move AND get rental income from one of the units for only $120k.

A Davidson County court hesitantly upheld a decision to allow two contested development projects to scale taller than outlined in the Rutledge Hill and Lafayette subdistrict community plans.

The ruling cements the Metro Planning Commission’s authority to grant a seemingly uncapped number of additional stories based on a structure's overall contribution to its neighborhood.  

Three residents of nearby Rutledge Hill condominium City Lights sued the commission in March, arguing that the panel overstepped its authority by approving additional height based on subjective factors on a site-by-site basis.

The commission relied on the Overall Height Modification process, which includes criteria such as "contribution to the skyline" and "improvement to the character of the neighborhood,” to approve more floors. 

While Davidson County Chancery Court Chancellor Anne C. Martin agreed the criteria were subjective, her May 2 ruling ultimately acknowledged the Metro Council's amendments to the Downtown Code grant the Planning Commission power to decide what constitutes the “exceptional design” required to extend height beyond neighborhood limits.

This one has been a saga.  This was one of the first big announcements I was a part of after joining the community.  From the first iteration to the initial protests to the second iteration and even more protests.  If/when this one and Centrum start, I'll pop open an imaginary champagne bottle.

I think I joined shortly after the Siggy announcement . . . my bottles were drained long ago, not in celebration, but out of impatience.
