I just wonder what their attitude would be if City Lights was surrounded on all sides by other 7 story buildings?  They still wouldn’t be able to see out.

Right?  Talk about a bad neighbor.  And I thought the lady with the noisy Chihuahua was bad.  At least she's not trying to single-handedly keep the neighborhood in the dark-ages because she thinks her patio view should stay stuck in time til the end of the earth!

Metro Planning Commission has approved the rezoning for the 3 tower project by a 6-1 vote.

It has to pass three reading of the Metro Council now that it is an SP. So, when the Council passes it the ding dongs at City Lights are going to try further delaying tactics by suing Metro Council. This is sort of defeating their whole premise of the original lawsuit as I said in a previous post because they were saying that Planning did not have the power to pass the height variance because Council did not give them that power. If they sue this time I am unsure what grounds, they will sue on since the entire Metro Council will have passed this and it will be Metro law with precedent as they have passed SP's like this before.

I know there are a lot of unknowns, but any guesses when construction might start?

Once the SP passes Metro council, expect the nummy nuts from City Light to file suit. They will try delaying tactics again, but I think it will be quickly tossed out of court. Just my opinion because they have not got a leg to stand on since the argument is mute because it was will have been passed by the entire council this time making it law.

They need to either move or just except the fact that they are going to have high-rise neighbors. I think their attorney is just leading them on now collecting fees and laughing all the way to the bank knowing this has not got a snowballs chance in hell. They should see the writing on the wall with defeat after defeat.

I’m so happy to see positive movement with this one. I knew the lawsuits wouldn’t really do anything, but I was worried time and inflation might’ve put this one in jeopardy. Glad to see that’s not the case!

A Davidson County Chancery Court judge has ruled against plaintiffs related to their attempt to stop two high-profile developments planned for downtown’s Rutledge Hill.

Judge Russell Perkins ruled the specific plan rezoning approved by the Metro Planning Commission was appropriately granted. The ruling will allow the two projects — one by Boston-based The Congress Group and the other by Chicago-based Centrum Realty and Development — to move forward.

Plaintiffs Steven Snyder, Andrew Decker and Gregory Breetz contended the planning commission should not have granted the rezoning. The three own condominiums at Rutledge Hill mixed-used building City Lights and, as part of their arguments, said the future towers for the two projects will block their views, thus potentially diminishing their property values.

Perkins ruled the plaintiffs will be required to pay the defendants’ attorney fees. The ruling is subject to appeal.

I guess they can think of the buildings as large permanent trees with no leaves. Anyway, that sure was an expensive lesson for them. They. Had to pay their own court cost and lawyer fees as well, so anyone want to take a guess as to what it cost them???

Dunno, but six figures, I reckon. Maybe  400k ? I just took 1000 hrs x avg $400/hour.  Fools and their money are soon parted, LOL. Classic.

I mean now that you mention it, the gripes of the City Lights folks really is akin to someone moving to the middle of the woods and complaining about all the trees.

The appeal challenging the zoning change is still active. Currently scheduled for oral argument in September.
