Anything and everything boils down to financing a project. That goes for the 2nd & Peabody project as well. They have yet to close on the land and the lawsuit seems to be active, however I think that has a snowflakes chance in hells of winning.

They would have to turn right around and bring suit against this group as well and at some point it will get really expensive for the frantic four at City Lights.

Also related to this area water sewer permit studies for 133 KVB are in the works and Taylor and myself are watching for the results to come back with anticipation.

Metro Planning Commission approved the height modifications (39, 32, and 29 stories) by a 5-3 vote.  By reminder, the concept plan was also approved in November. Everything moving forward nicely.

There was concern from one of the commissioners about how much bonus is being given, the plan is 6-7x the base height for the site, another commissioner was concerned about “preserving site lines from Fort Negly” (ps, Haven has already ruined those, and that was built without a modification as far as I can tell), and the other wants to see stronger regulation / requirements for “vertical neighborhoods” before we start approving this type of development.

Don't forget there will probably be another lawsuit which will delay this and 2nd & Peabody some. I suspect that both of the lawsuits will be combined into one and the Freaky Four and their lawyer will face the Metro lawyers along with the lawyers from the Congress Group and now Centrum and the owner of that property.  

He will definitely be outgunned in court whenever this thing gets there.

How much of Nashville's mayoral election conversations talk about how the mayor's office appoints this commission? Feels like a lot of power in the hands of the mayor to shape the future of the city in a way that I haven't heard much conversation.

I think the way the downtown is reshaped is more of a district 19 item that a mayoral issue. It's pretty much up to Freddie to change the zoning in his district to get the ball rolling and as of yet he has done nothing to address this. I hear it is on the works and that issue is pretty much a hands-off issue for the mayor as again it is a district issue IMO.  

I can't remember if planning commission is appointed by the council or the mayor. But I will bet it is just like the Fair commission and appointed by Metro Council.

 

Someone please correct if I am mistaken as I don't keep up on a lot of this.

Most boards and commissions are appointed by the mayor and approved by council.

You're right. Per the Metro Charter: 

"Eight (8) members shall be appointed by the mayor and shall be confirmed by a majority vote of the whole membership of the council."

So in fact Metro Council in fact is giving approval  through these committees. If it went through Metro Council as always if the bill is supported by the council member it is passed. 

 

The lawsuit then will be found to have no merit and dismissed IMO.

I'm sorry, I got stuck on this statement... "preserving site lines from Fort Negley."  Isn't Fort Negley across I-40 on a hill behind the Adventure Science Center?  So, just what site lines would this project impede?  The Four Seasons?  The batman building?  The hills off in the distance?   What view needs to be protected and of what?  It's facing the core of the city.  What site lines need to be protected for a park? 

I can just imagine a NYC commissioner voting against a new building across from the south end of Central Park to preserve site lines of lower Manhattan in the distance...

Are they being deferred? I know there was some talk during the meeting about reviewing the process, but I would think that projects that had already submitted their application / entered the process publicly under the rules as currently written would continue on like normal.

The only thing that should be debated is going ahead and allowing anything that is obviously downtown Nashville to go as high as they could possibly want. Especially if you earn it with next level design like this and 2nd and Peabody. Cumulus site is obviously downtown as far as I’m concerned.

We need the height, we need the density, period.

The way Nashville is going, the more you artificially cap these buildings, the greater your regret will be years down the line.

As I’ve made mentioned before, I believe that all this nonsense about height here in Nashville comes from people and that includes elected officials, that still live in the past. They remember the “ Old Nashville “ with its “ small town feeling “ and “ country charm” . While it’s important to retain that aspect and preserve the history wherever possible, it’s important to understand that Nashville is and has become a big metropolis. Forward thinking is now critical to plan for what lies ahead. Stop thinking and planning one project at a time , think about all that has already been approved ( Oracle, the rest of NY, Ritz, Circle South..etc) and now The East Bank plans. We here on UrbanPlanet all see it and can visualize what it’s all going to look like in 5-10-15 years, but most can’t. The city needs to embrace what lies ahead, start thinking like the major player that it has become, and start putting together a plan that allows for the heights and density that comes with being a true Metropolis.

The Mayor appoints most Board and Commission members but they are approved by Council. This does not always mean that the Board and Commission members do whatever the Mayor or Council propose. The Mayor’s Office can contact Board and Commission members directly on upcoming agenda items. I’m not sure how often Mayor Cooper or any other mayor dies that. 

For the Planning Commission, eight members are mayoral appointees with one member being the mayor’s representative. In this case that is former CM Mina Johnson. The 9th Planning Commission member is elected by the Metro Council directly. I was elected to fill that role for the second half of this term. I voted in support of this height modification request.
