I'd be concerned that if this person is prosecuted the ruling could be abused. On the other hand a parent has the responsibiltity to make the right decisions for the welfare of a child. This is a tough one...

I think if you're going to charge the mother with murder you charge the doctor with murder too. I understand she was told that the baby may die, but we don't know the reason(s) behind her not wanting to get a c-section. It wasn't even known to her that she could be brought up on murder charges. IMO I don't think she wanted to murder her unborn baby, rather she was just uneducated in the matter.

PArdon my ignorance of the female gender, but what is a Caesarian section again (is it when they cut through your womb?) and why is it bad for "cosmetic reasons" - does the scar last?
