Courts now get a spin at slots

Judges in Broward and Leon counties will be looking at whether four parimutuel facilities can move ahead on slot machines after the Legislature failed to write the rules.

Broward parimutuel and anti-casino interests filed competing lawsuits this week, each asking a judge to settle the dispute over whether three racetracks and one jai-alai fronton may install slot machines this year.

The parimutuels want a court's approval in Broward to move forward on installing slot machines. The No Casinos group asked a Tallahassee judge to rule that no one could go ahead with slots until the Legislature acts.

The Tallahassee suit was filed on Monday, the Broward suit on Tuesday.

The Legislature set the stage for this legal showdown by failing to set rules for the operation of slot machines, which were approved by Broward County voters in March.

oooh... some competition between the Seminoles and the racetracks... It will be interesting to see what projects will come of this, hotel, entertainment, and otherwise. The State Road 7 (US 441) corridor surrounding the Seminole Hard Rock is on a major rebound right now. The tribe has even offered to pay for the Turnpike to build an exit at Stirling Road... Right now you have to use either Griffin Rd, Hollywood Blvd or I-595 to US 441.

A Broward circuit court judge sided with the parimutuel industry, affirming their right to operate slot machines by the July 1st deadline provided by the slots constitutional amendment. The ruling gives the Broward County Commission until July 1st to set up some rules on slots. The ruling also bars the State Attorney's Office from prosecuting the parimutuels.

A judge has ruled that the parimutuels caught in legal wrangling can go ahead and install their slot machines while their suit goes through the appellate process.

They cannot open for business until regulations are written, either by the Legislature or the Broward County Commission. A special session of the Legislature may be called for this, since legislators failed to come up with anything by the end of the regular session earlier this year.
